§ 1. General Provisions

1. The organiser of the Workshops is wolespac. registered at Hendrik Racesteijnplein 4, 2282GS Rijswijk. Chamber of Commerce (KvK) no. 82535388, VAT (BTW) no. NL003695076B63. Contact: wolespac@gmail.com, website wolespac.com.

2. These Terms & Conditions (“Terms”) govern the painting workshops for groups (often called “sip & paint”), including the supply of paints, canvases and instruction.

3. By making a reservation, the Participant accepts these Terms in full.

§ 2. Definitions

Participant – the consumer or legal person for whom a reservation is made and who attends the Workshop.

Reservation – the Participant’s booking via the online form, email or telephone, confirmed by the Organiser.

Workshop Date – the date and start time of the Workshop as specified in the confirmation.

§ 3. Booking and Payment

1. A reservation is binding once the full Workshop fee has been received by the Organiser’s bank account no. NL64 KNAB 0408 9804 35 or via online payment.

2. Prices quoted are VAT-inclusive and cover all materials and instruction.

3. The Organiser will send a booking confirmation containing the Workshop Date, invoice number and payment receipt.

§ 4. Changes and Cancellations by Participant

1. All payments are non-refundable. No refunds are given after payment has cleared.

2. However, the Participant may reschedule once, free of charge, to another available Workshop Date, provided the request is received no later than 3 calendar days before the original Workshop Date. Requests must be emailed to  wolespac@gmail.com.

3. After the 3-day deadline, the payment is forfeited and no rescheduling or refund is possible.

§ 5. Cancellation or Rescheduling by Organiser

1. The Organiser may cancel or reschedule a Workshop in case of:

a. insufficient enrolment (fewer than 4 Participants),

b. force majeure (e.g. extreme weather, government restrictions),

c. illness of the instructor.

2. The Organiser will notify Participants at least 5 days before the Workshop. In that event, Participants may choose either:

a. a new Workshop Date at no extra cost, or

b. a full refund of the fee paid.

§ 6. Participant Obligations

1. Participants shall arrive at least 10 minutes before the start time.

2. Participants must follow the instructor’s safety and hygiene instructions and keep the workspace tidy.

3. Use of personal painting materials is only with the Organiser’s prior approval.

§ 7. Liability

1. The Organiser is not liable for damage to clothing or personal belongings; Participants use the provided aprons at their own risk.

2. Participants are responsible for any damage they cause to the venue or equipment and must compensate the Organiser under Articles 6:74 and 6:162 of the Dutch Civil Code.

§ 8. Personal Data

1. Participant data are processed in accordance with Regulation (EU) 2016/679 (GDPR) on the legal basis of contract performance (Art. 6(1)(b) GDPR).

2. Participants have the right to access, rectify, erase or restrict processing of their personal data.

§ 9. Applicable Law and Final Provisions

1. These Terms are governed by Dutch law.

2. Consumer rights not regulated here are governed by Book 6 of the Dutch Civil Code, in particular:

Art. 6:230p(e) BW – no right of withdrawal for leisure services with a fixed date  .

Art. 6:230o BW – 14-day cooling-off period for distance contracts (not applicable here due to exemption under 6:230p)  .

3. In disputes between a Participant who is a consumer and the Organiser, the statutory rules on unfair contract terms (Directive 93/13/EEC, implemented in Dutch law) apply.

§ 10. Use of Photography and Videography for Marketing Purposes

10.1 During the Workshops, the Organiser (or its authorised representatives) may capture photographs and videos of Participants at work or engaging in workshop activities.

10.2 By attending the Workshop and remaining on the premises, you grant the Organiser an irrevocable, royalty-free, worldwide licence to use, reproduce, publish and display such photographs and videos in any media (including but not limited to the Organiser’s website, social media channels, email newsletters, printed flyers and other promotional materials) for marketing and promotional purposes without further approval or compensation.

10.3 If you do not wish to be photographed or filmed, please notify the Organiser in writing at wolespac@gmail.com at least 48 hours before the Workshop, and/or inform the instructor or staff on arrival. We will make reasonable efforts to accommodate your request, but cannot guarantee complete exclusion once the session has begun.

§ 11. Code of Conduct

11.1 Participants are expected to behave in a respectful, courteous and collaborative manner at all times. Any form of harassment, discrimination, abusive or disruptive behaviour towards the instructor, staff or other Participants will result in immediate removal from the Workshop, without entitlement to any refund or rescheduling.

11.2 Participants must follow all safety, hygiene and workshop guidelines as communicated by the instructor. This includes proper use of art materials, respecting property and shared spaces, and maintaining a clean workspace.

11.3 The Organiser reserves the right to refuse entry or participation to any Participant whose conduct is deemed inappropriate or unsafe, at the Organiser’s sole discretion.
